Online sexual harassment prevention training is NOT compliant for California janitorial service providers.

Here’s why:
In 2019, California passed Assembly Bill (AB) 547, which requires janitorial employers to provide in-person training in preventing sexual violence and harassment at least once every two years.
While the training must be offered by a qualified trainer under the statute, and must use the curriculum developed by the Labor Occupational Health Program (LOHP) under the direction of the Department of Industrial Relations, the training must also be delivered in-person. In-person requires classroom training. Therefore online training cannot be compliant with AB 547 requirements.
AB 547 harassment training versus SB 1343 SHPT
There are other key differences between the training that must be provided by janitorial service companies and the state minimum requirement otherwise.
For example, janitorial service providers must provide two hours of training to both supervisory and nonsupervisory workers, whereas the state minimum requirement outside of AB 547 calls for only supervisors to receive two hours of training, while nonsupervisory personnel only need one hour of SHPT.
AB 547 harassment training is limited in scope
AB 547 doesn’t apply to companies that hire janitorial service providers. So if your office cleaner is an independent contractor, they take care of this training themself. There are worker job duties exclusions too, having to do with specialization and other job requirements. So even within the profession, the impact of AB 547 is limited.
