Who is a Supervisor under CA SB-1343?
A person qualifies as a supervisor for purposes of the California Fair Employment and Housing Act (FEHA) if they have the discretion and authority to:

(a) hire, transfer, promote, assign, reward, discipline, or discharge other employees, or effectively recommend any of these actions;

(b) act on the grievances of other employees or to effectively recommend action on grievances; or
-
(c) direct staff members’ daily work activities.
Of note is that this definition is only concerned with the job function, not the job title.
As a result, many people may not realize that they need to take the two hour Supervisor training when completing their SB-1343 compliance course.
Most small business owners are supervisors.
Many non-profit volunteer coordinators are also supervisors under the statute’s definition.
It’s important to choose the correct course for the correct role. Taking the non-supervisor course twice will provide two hours of training, but will not provide the correct content, and thus will not meet the SB-1343 requirements, for a supervisor.
